FLEXRACKby Qcells is an integrated solar company that offers custom-designed, fixed tilt ground mount and single-axis solar tracking systems in the commercial and utility-scale solar mounting industries. FLEXRACK by Qcells also offers full services, including engineering, geotechnical, pullout testing, field, and layout design services to address the actual site conditions of a project site. Solar FlexRack has completed over 3.5 GW of solar racking installations in over 40 U.S. states, 9 Canadian provinces and across the globe.
SUMMARY
The Contract Manager will oversee all aspects of customer and vendor contact negotiations and maintenance from a legal and financial perspective with a focus on timelines, budget and risk management. This position reports to the Head of Finance, or another management personnel that the President of the Company may designate. This position is hybrid, Monday - Thursday in office and Friday remote. This position is located in Cleveland, OH and working hours are Monday through Friday, from 8:00am to 5:00pm or 9:00am to 6:00pm local time. Overtime and weekend working hours may be required as needed. This position is not expected to travel.

ESSENTIAL JOB FUNCTION & RESPONSIBILITIES

  • Oversee all aspects of the contract process including review, negotiation and approval of applicable terms and conditions, pricing alignment with negotiations/quotations, scheduling constraints and risk management.
  • Understand and apply the Company’s contract policies including finance matters, credit, sales tax, product warranties, indemnification terms, and other matters that may impact drafting and negotiating a contract.
  • Key contact to coordinate and communicate with customers and suppliers – both internal and external, domestic and foreign-based, at all organizational levels.
  • Develop solutions to complex contracting issues, which require the regular use of ingenuity and innovation. Ensure solutions are consistent with the Company’s objectives, such as developing MSA’s with key customers for commercial ease.
  • Identify and assess contractual risks and relay issues to management in a concise manner to obtain required approval from appropriate departments for non-standard contract provisions, following-up to secure timely responses.
  • Seek advice from and keep GES Qcells Legal informed of all major contract negotiations or other contract related matters.
  • Oversee contractual flow-down requirements to all interdepartmental team members, including, Finance, Estimating/Quoting, Engineering, Supply Chain Management, Purchasing, Project Management, Shipping for visibility and awareness to support implementation.
  • Manage all workflow related to contract activities through close-out procedures, including monitoring key contractual terms, shipping status, LD’s, payment, filing of liens, and issuance of product warranties.
  • Provide ideas and innovations to improve upon existing systems, work processes and procedures and regularly contribute to the ongoing development of best practices, business strategy, new concepts, techniques, and standards.

REQUIRED QUALIFICATIONS

  • Education – BS BA Major in Business, Finance
  • Five or more years of progressive experience drafting, negotiating and executing contracts preferably in the construction or similar project based industry. Knowledge of import/export law, government contracting and/or multi-state lien processes a plus.
  • Certifications/Licenses
  • JD and/or CPA preferred

  • Sight: frequent use of sight to detect images on computer, office documents, and office objects near and far
  • Climb: occasionally ascends/descends on stairway to get to office upper and lower floors
  • Travel: Not required.
